Using The Message Boards
To post a message to the message board, click the "Post" button on the front page of each board. You will be taken to a form that you will fill out in order to post your message. Your name and e-mail address are required for all postings. Upon posting a message a confirmation screen will appear. It is very important that you do not reload the confirmation screen. Instead, click one of the buttons to go to your message, or go to the Home page of the Message Board.

Viewing Recent Messages
On each board there is a dropdown provided that enables the user to view messages posted within the last XX days. This dropdown will search the individual board for all posts made within the last XX days.

Notify Me via E-mail
If you would like receive an e-mail notification when someone posts another message to the same thread you posted to, click the checkbox on the post screen. You will receive an e-mail notifying you of a response to that thread.

Searching The Message Boards
Each message board has a search button that takes you to the search page. You can search all the message boards by keyword as well as other fields. Please remember to narrow your search as much as possible. For more information please see the search page.

Searching The Archives
Not all messages are indexed in the main page for each board. However, we have a very large number of archived messages that can be searched. The one search page will search ALL messages, including the archives.

GUIDELINES FOR POSTING

We do not intend to sensor our message boards but instead we encourage open discussion. We do however reserve the right to enforcethese guidelines by restricting those who do not follow these guidelines from posting messages to our boards. We ask that you please follow a few simple guidelines:

• Post It Once - Please do not post the same or similar message on more than one board, or more than one time on a board. This only crowds the boards and makes things slower. Cross posts will be removed without notice. This means posting a For sale message on the a hardware board AND on the Classifieds board. These board track IPs and e-mails and if this becomes a problem we will not hesitate to restrict your access to the boards.

• Keep Advertising Out - Please do not post commercial advertising for your company or product. Press releases and other pertinent news can be posted on the Announcement boards. If your message has no other value than to let people know that they can purchase a product from you, it will be removed. "We're the best" and other similar messages will be also be deleted. This includes advertisements for other web sites and similar products. Even if you have a FREE service, this kind of posting is not allowed. If you would like to advertise your product with PDAStreet.com we have those opportunities available, but more importantly our users do not wish to wade through advertising SPAM.

• Keep It Clean - As stated earlier we do not wish to sensor these boards. We do however ask that you do not use vulgarity on these boards. We reserve the right to remove any message that is deemed vulgar in the eyes of PDAStreet.com.

• Keep the Subject Short And To The Point - Please do not submit excessively long subject lines to gain attention. These will be removed.

• Keep it Legal - We will not tolerate any postings with illegal activity mentioned or suggested. This includes but is not limited to selling/trading hacked or pirated software, libeling commercial businesses, impersonating other individuals who are publicly known or unknown, or any other illegal activity. Messages will be removed as soon as we are aware of them, and the poster could lose posting rights at PDAStreet.com.

• Keep it Relevant - Please do not post messages that aren't related to the board's topic. All other messages will be considered SPAM, and will be removed.

These guidelines are here for the protection of everyone and will be enforced diligently. There is so much "noise" in newsgroups and online forums that we are attempting to keep a clean, well organized environment for everyone. Anyone who cannot abide by these simple guidelines will lose the priveledge of posting to our boards without notification.

1. MEMBER CONDUCT

The Service is designed to promote the exchange of ideas related to a particular message board topic.

The opinions and views expressed by people using the Service do not reflect those of INTM. The contents of messages are based on data submitted by individual users, and INTM may not review, screen or edit messages posted in any message board. INTM encourages you to bring violations of the Terms of Use to INTM's attention, although we do not guarantee any action based on such information.

You agree to abide by all applicable local, state, national and international laws and regulations when using the Service, and that you are solely responsible for all acts or omissions that occur on any messages that you post.

INTM reserves the right to terminate your use of the Service, or to remove any message or posting from the Service at any time, without notice, in INTM's sole discretion. By way of example, and not as a limitation, you agree that INTM may remove content or messages, or terminate your use of the Service, if INTM believes, in its sole discretion, that you are engaged in any of the following activities:

a) Using the service for illegal purposes or for posting material that is unlawful, harassing, abusive, threatening, harmful, vulgar, obscene, tortuous, libelous, invasive of another's privacy, or otherwise objectionable, including but not limited to material that contains blatant expressions of bigotry, prejudice, racism, hatred, or profanity, or that promotes or provides instructional information about illegal activities or promotes physical harm or injury against any group or individual;

b) Violating the rights of third parties, including but not limited to rights of publicity, copyright, trademark, patent, trade secret and other intellectual property rights;

c) Interfering with or disrupting the Service -- or servers, computer systems, or networks connected to the Service -- or interfering with another user's use and enjoyment of the Service, including but not limited to (i) transmitting any material that contains viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs, or (ii) attempting to gain unauthorized access to the Service, or other's accounts on the Service;

d) Harvesting or otherwise collecting information about others, including e-mail addresses, without their consent;

e) Providing false information on your registration form, or attempting to mislead others as to the identity of the sender or the origin of a message;

f) Posting content that consists of hyperlinks to Web sites that contain content not allowed on the Service;

g) Posting content related to the listing or sale of any goods or services, including but not limited to any item that is illegal to sell under any applicable law, statute, ordinance or regulation including the following:

- Food,
- Alcoholic beverages,
- Firearms, ammunition, explosive materials,
- Cigarettes or any other tobacco product for human consumption,
- Pharmaceuticals or any other controlled substance or paraphernalia,
- Dangerous, counterfeit or stolen goods,
- Goods which do not actually exist,
- Body parts or remains,
- Any good that infringes or violates anyone's rights,
- Software programs designed to disrupt computer or other equipment,
- Pirated computer programs or links to such programs,
- Pirated music or tablature or links to such files,
- Any type of cracker utility,
- Stocks and other securities,
- Illegal goods,
- Profane or sexually explicit advertisements or requests,
- Misleading offers,
- "bait & switch" of products,
- Postings that offer no items for sale,
- Make-money fast schemes,
- pyramid or chain letters,
- Fraudulent or criminal offers,
- Postings with the goal of harassment of another,
- Fraudulent advertisements,
- Unsolicited email ("SPAM"),
h) Posting any content which constitutes a raffle or contest that require any type of entry fee;

i) Posting a request, solicitation, or advertisement for an employment position;

j) Posting files or information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs;

k) Posting any content which discloses personal or private information concerning any person or entity, including without limitation phone number(s) or addresses, credit debit cards, calling card, User account numbers/ passwords or similar financial information, and home phone numbers or addresses;

l) Posting any content which in INTM 's sole discretion is inflammatory, offensive or otherwise inconsistent with INTM 's standards of business ethics; and

m) Posting any messages, data, or images that in INTM 's sole discretion is obscene or which contain racial, ethnic, religious slurs or derogatory epithets, or advocating violence, hate or other language that is offensive or harassing.

2. TERMINATION

Any misuse of the Service, as determined solely by INTM, will cause termination of your use of the Service.

INTM reserves the right to delete all data or postings made by you in any message board with or without cause at any time and effective immediately, without prior notice.

3. NO SPAM

INTM will immediately terminate any Service member that it believes, in its sole discretion, is using the Service for transmitting any junk mail, spam, chain letters, or other unsolicited bulk e-mail, commercial or otherwise.

4. PROPRIETARY RIGHTS

a) You agree that upon posting any material on the Service, you grant INTM, and its successors and assigns, a non-exclusive, worldwide, royalty free, perpetual, non-revocable license under copyright or other intellectual property rights, if any, in such material, to use, distribute, display, reproduce, and create derivative works from such material on the Internet and in any and all other media, in any manner, in whole or part, without any duty to account to you. You also grant INTM the right to authorize the downloading and printing in whole or in part of any material that you have posted to the Service, by end-users for their personal use.

b) You acknowledge and agree that content, including but not limited to text, software, music, sound, photographs, graphics, video, page layout and design or other material contained in the Service or information presented through the Service by INTM or INTM's advertisers is protected by their copyrights, trademarks, service marks, patents, or other proprietary rights and laws. You acknowledge and agree that INTM can display images and text throughout the Service, including the insertion of sponsor messages into messages distributed on the Service.

5. INDEMNIFICATION

You agree to indemnify, defend and hold harmless INTM, its subsidiaries, affiliates, officers, and employees from any loss, liability, claim, demand, damage, or expenses (including reasonable attorney's fees and costs) asserted by any third party due to or arising from or in connection with your use of, conduct on, or postings on the Service. INTM reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, which shall not excuse your indemnity obligations.

6. MODIFICATIONS TO TERMS OF USE OR TO THE SERVICE

INTM reserves the right to change the Terms of Use at any time without notice. INTM also reserves the right to modify or discontinue the Service, temporarily or permanently, with or without notice to you. You agree that INTM shall not be liable to you or any third party for any modification to or discontinuance of the Service.

7. DISCLAIMER OF WARRANTIES

THE MATERIALS AVAILABLE THROUGH INTM AND ANY THIRD PARTY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND EITHER EXPRESS OR IMPLIED. INTM DOES NOT CONTROL IN ANY RESPECT ANY INFORMATION, PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES ON THE SERVICE. YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK.

INTM IS NOT RESPONSIBLE FOR THE CONTENT OF MESSAGES DISTRIBUTED THROUGH THE SERVICE, AND ASSUMES NO RESPONSIBILITY FOR AND MAKES NO WARRANTY OR REPRESENTATION AS TO THE ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY OR USEFULNESS OF INFORMATION DISTRIBUTED THROUGH THIS SERVICE.

INTM MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, NOR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. INTM DOES NOT MAKE ANY WARRANTY OR REPRESENTATION AS TO THE USE OR THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE. YOU SHOULD NOT RELY ON ANY INFORMATION ON THE SERVICE WITHOUT FURTHER CONSULTATION AND REVIEW.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, SHALL INTM BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE, OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF INTM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. MISCELLANEOUS

The Terms of Use and the relationship between you and INTM shall be governed by and construed in accordance with the laws of the State of Connecticut and the United States without regard to conflict of law provisions. You and INTM agree to submit to the personal and exclusive jurisdiction of the courts located in the state of Connecticut.

The failure of INTM to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid or contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the parties' intentions, and the other provisions of the Terms of Use shall remain in full force and effect.

I HAVE READ AND UNDERSTAND THE FOREGOING TERMS OF USE AND AGREE TO BE BOUND BY ALL OF ITS TERMS.
